                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the transport of hazardous materials through cities.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  For the purposes of this act, city means an area
 1-5     of businesses, residences, and other structures or entities which
 1-6     contain more than 500,000 people and do not already have
 1-7     ordinances, rules or statutes that restrict the transport of
 1-8     hazardous materials on federal, county, or state roadways.
 1-9           SECTION 2.  No trucks or trailers carrying hazardous
1-10     materials shall travel through any city during peak transportation
1-11     hours.
1-12           SECTION 3.  Each city shall establish their peak
1-13     transportation hours.
1-14           SECTION 4.  This Act takes effect September 1, 1999.
1-15           SECTION 5.  The importance of this legislation and the
1-16     crowded condition of the calendars in both houses create an
1-17     emergency and an imperative public necessity that the
1-18     constitutional rule requiring bills to be read on three several
1-19     days in each house be suspended, and this rule is hereby suspended.
