A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to the board of directors of the Big Bend Regional
1-3 Hospital District.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 7(b), Chapter 643, Acts of the 59th
1-6 Legislature, Regular Session, 1965, is amended to read as follows:
1-7 (b) An election shall be held on the first Saturday in May
1-8 each year and the appropriate number of directors shall be elected
1-9 for four-year [two-year] terms in the following manner:
1-10 (1) In an election held in the year 2000 for the
1-11 election of directors serving a term that expires on that year, the
1-12 term shall be a two-year term;
1-13 (2) In an election held in the year 2001 for the
1-14 election of directors serving a term that expires on that year, the
1-15 term shall be a three-year term; and
1-16 (3) Every election for a member of the board of
1-17 directors held after 2001 shall be for a term of four-years. In
1-18 every case the directors shall serve until the successors have been
1-19 elected and qualified for the office.
1-20 SECTION 2. Section 7B, Chapter 643, Acts of the 59th
1-21 Legislature, Regular Session, 1965, is amended by adding Subsection
2-1 (c) to read as follows:
2-2 (c) A person may not serve on the board of directors if the
2-3 person:
2-4 (1) is an employee of the district; or
2-5 (2) is a party to a contract with the district to
2-6 perform services for compensation; or
2-7 (3) is a physician who retains staff privileges at a
2-8 district facility.
2-9 SECTION 3. The changes in law made by this Act to Sections
2-10 7(b) and 7B, Chapter 643, Acts of the 59th Legislature, Regular
2-11 Session, 1965, do not apply to a member of the board of directors
2-12 of the Big Bend Regional Hospital District serving on the board
2-13 immediately before September 1, 1999, for the remainder of that
2-14 member's term. The changes in law apply only to a member elected
2-15 on or after September 1, 1999.
2-16 SECTION 4. This Act takes effect September 1, 1999.
2-17 SECTION 5. The importance of this legislation and the
2-18 crowded condition of the calendars in both houses create an
2-19 emergency and an imperative public necessity that the
2-20 constitutional rule requiring bills to be read on three several
2-21 days in each house be suspended, and this rule is hereby suspended.
