                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the jurisdiction of statutory probate courts.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 25.0021, Government Code, is amended to
 1-5     read as follows:
 1-6           Sec. 25.0021.  JURISDICTION.  (a)  If a provision of this
 1-7     subchapter conflicts with a specific provision for a particular
 1-8     court or county, the specific provision controls except that this
 1-9     subchapter controls over a specific provision for a particular
1-10     court or county if the specific provision attempts to create
1-11     jurisdiction in a statutory probate court other than jurisdiction
1-12     over probate, guardianship, mental health, or eminent domain
1-13     proceedings.
1-14           (b)  A statutory probate court as that term is defined in
1-15     Section 3(ii), Texas Probate Code, has the general jurisdiction of
1-16     a probate court as provided by the Texas Probate Code.
1-17           SECTION 2.  Section 25.00266, Government Code, and Section
1-18     25.0032, Government Code, as added by Chapter 394, Acts of the 72nd
1-19     Legislature, Regular Session, 1991, are repealed.
1-20           SECTION 3.  This Act takes effect September 1, 1999.
1-21           SECTION 4.  This Act applies only to the jurisdiction of
1-22     cases filed on or after the effective date of this Act.  The
1-23     jurisdiction of a case filed before the effective date of this Act
1-24     is governed by the law as it existed immediately before the
 2-1     effective date of this Act, and that law is continued in effect for
 2-2     that purpose.
