No. 3786 1-2 (In the Senate - Received from the House May 13, 1999; 1-3 May 14, 1999, read first time and referred to Committee on 1-4 Jurisprudence; May 14, 1999, reported favorably by the following 1-5 vote: Yeas 3, Nays 0; May 14, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the transfer of certain proceedings in a suit affecting 1-9 the parent-child relationship. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Section 155.201, Family Code, is amended by 1-12 adding Subsection (c) to read as follows: 1-13 (c) If a suit to modify or a motion to enforce an order is 1-14 pending at the time a subsequent suit to modify or motion to 1-15 enforce is filed, the court may transfer the proceeding as provided 1-16 by Subsection (b) only if the court could have transferred the 1-17 proceeding at the time the first motion or suit was filed. 1-18 SECTION 2. This Act takes effect September 1, 1999, and 1-19 applies to a suit to modify or a motion to enforce an order in a 1-20 suit affecting the parent-child relationship pending on or after 1-21 that date. 1-22 SECTION 3. The importance of this legislation and the 1-23 crowded condition of the calendars in both houses create an 1-24 emergency and an imperative public necessity that the 1-25 constitutional rule requiring bills to be read on three several 1-26 days in each house be suspended, and this rule is hereby suspended. 1-27 * * * * *
