                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to certain post-mortem procedures.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Chapter 693, Health and Safety Code, is amended
 1-5     by adding Subchapter D to read as follows:
 1-6                       SUBCHAPTER D.  REMOVAL OF SPERM
 1-7           Sec. 693.051.  REMOVAL OF SPERM FOR REPRODUCTIVE PURPOSES.  A
 1-8     person may not remove sperm from a decedent for reproductive
 1-9     purposes unless:
1-10                 (1)  the removal is performed at the request of the
1-11     decedent's spouse; and
1-12                 (2)  the decedent had, before death, given written
1-13     consent to the removal of sperm after death.
1-14           SECTION 2.  The heading of Chapter 693, Health and Safety
1-15     Code, is amended to read as follows:
1-16       CHAPTER 693. REMOVAL OF BODY PARTS, BODY TISSUE, [AND] CORNEAL
1-17                         TISSUE, AND OTHER MATERIAL
1-18           SECTION 3.  This Act takes effect September 1, 1999.
1-19           SECTION 4.  The importance of this legislation and the
1-20     crowded condition of the calendars in both houses create an
1-21     emergency and an imperative public necessity that the
1-22     constitutional rule requiring bills to be read on three several
1-23     days in each house be suspended, and this rule is hereby suspended.
