No. 137 76R9252 SKT-D HOUSE CONCURRENT RESOLUTION 1-1 WHEREAS, King Consultants, Inc., dba Quicksilver Construction 1-2 alleges that: 1-3 (1) King Consultants, Inc., dba Quicksilver 1-4 Construction entered into a contract with Texas Woman's University 1-5 to demolish a building at the Texas Woman's University campus; 1-6 (2) Quicksilver Construction subcontracted with 1-7 Mr. Chad Lauderback to perform the demolition; 1-8 (3) Mr. Lauderback claims he was required to do 1-9 substantial amounts of extra work because of water from an 1-10 underground spring beneath the building; 1-11 (4) Mr. Lauderback claims that Texas Woman's 1-12 University knew about the existence of the underground spring but 1-13 concealed that information from Quicksilver Construction and him; 1-14 (5) Mr. Lauderback did not reveal to Quicksilver 1-15 Construction any information about the underground spring or that 1-16 he was having problems with water until after the alleged extra 1-17 work was performed; 1-18 (6) Texas Woman's University had knowledge of the 1-19 problems encountered by Mr. Lauderback and was aware of the extra 1-20 work that was performed by Mr. Lauderback; 1-21 (7) Mr. Lauderback has filed a suit against 1-22 Quicksilver Construction to recover compensation for the extra work 1-23 that was performed; and 1-24 (8) Quicksilver Construction seeks to name Texas 2-1 Woman's University as a third party defendant in order to have all 2-2 issues relating to the suit resolved at once; now, therefore, be it 2-3 RESOLVED by the Legislature of the State of Texas, That King 2-4 Consultants, Inc., dba Quicksilver Construction is granted 2-5 permission to sue the State of Texas and Texas Woman's University 2-6 subject to Chapter 107, Civil Practice and Remedies Code; and, be 2-7 it further 2-8 RESOLVED, That the presiding officer of the board of regents 2-9 of Texas Woman's University be served process as provided by 2-10 Section 107.002(a)(3), Civil Practice and Remedies Code.
