By Solis of Cameron, Hinojosa, Gutierrez, H.C.R. No. 243 Wise, Flores 76R13281 MDR-D HOUSE CONCURRENT RESOLUTION 1-1 WHEREAS, A group of commissioned and noncommissioned officers 1-2 employed by the Department of Public Safety of the State of Texas 1-3 allege that: 1-4 (1) the officers are highway troopers, lieutenants, 1-5 captains, sergeants, drug enforcement officers, capitol police, 1-6 special crimes officers, and other commissioned and noncommissioned 1-7 officers employed by the department; 1-8 (2) the department has structured and administered the 1-9 compensation of the officers so that the officers are not 1-10 compensated for overtime hours worked in accordance with law and 1-11 are not awarded compensatory time in accordance with law; 1-12 (3) the practices of the department that relate to 1-13 overtime hours worked by the officers violate state and federal 1-14 law; and 1-15 (4) the officers are entitled to damages and any other 1-16 relief allowed by law; now, therefore, be it 1-17 RESOLVED by the Legislature of the State of Texas, That the 1-18 officers are granted permission to sue the State of Texas and the 1-19 Department of Public Safety of the State of Texas subject to 1-20 Chapter 107, Civil Practice and Remedies Code; and, be it further 1-21 RESOLVED, That the director of the Department of Public 1-22 Safety of the State of Texas be served process as provided by 1-23 Section 107.002(a)(3), Civil Practice and Remedies Code.
