A JOINT RESOLUTION 1-1 proposing a constitutional amendment creating a vacancy in a 1-2 judicial office if a judge becomes a candidate for a non-judicial, 1-3 public elective office. 1-4 BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Article V, Texas Constitution, is amended by 1-6 adding Section 7b to read as follows: 1-7 Sec. 7b. A person holding a judicial office who announces 1-8 that person's candidacy or otherwise becomes a candidate in a 1-9 contested primary, general, or special election for any office of 1-10 profit or trust under the laws of this state or the United States, 1-11 other than another judicial office, vacates the judicial office 1-12 that the person holds on the date of the announcement or candidacy. 1-13 A person may continue to hold judicial office while being a 1-14 candidate for election to or serving as a delegate in a state 1-15 constitutional convention or while being a candidate for election 1-16 to any judicial office. A vacancy created under this section is 1-17 filled according to the procedure established for the vacated 1-18 office. 1-19 SECTION 2. This proposed constitutional amendment shall be 1-20 submitted to the voters at an election to be held November 2, 1999. 1-21 The ballot shall be printed to provide for voting for or against 2-1 the proposition: "The constitutional amendment creating a vacancy 2-2 in a judicial office if a judge becomes a candidate for a 2-3 non-judicial, public elective office."
