R E S O L U T I O N
 1-1           BE IT RESOLVED by the House of Representatives of the State
 1-2     of Texas, 76th Legislature, Regular Session, 1999, That House Rule
 1-3     13, Section 9(a), be suspended in part as provided by House Rule
 1-4     13, Section 9(f), to enable the conference committee appointed to
 1-5     resolve the differences between the house and senate versions of
 1-6     H.B. No. 1275, relating to providing a parent with a copy of a
 1-7     special education student's education plan translated into the
 1-8     parent's native language, to consider and take action on the
 1-9     following matter:
1-10           House Rule 13, Sections 9(a)(3) and (4), are suspended to
1-11     permit the committee to add text to read as follows:
1-12           SECTION 1.  Section 29.005, Education Code, is amended by
1-13     adding Subsection (d) to read as follows:
1-14           (d)  If the child's parent is unable to speak English, the
1-15     district shall:
1-16                 (1)  provide the parent with a written or audiotaped
1-17     copy of the child's individualized education program translated
1-18     into Spanish if Spanish is the parent's native language; or
1-19                 (2)  if the parent's native language is a language
1-20     other than Spanish, make a good faith effort to provide the parent
1-21     with a written or audiotaped copy of the child's individualized
1-22     education program translated into the parent's native language.
1-23           SECTION 2.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
1-25     emergency and an imperative public necessity that the
 2-1     constitutional rule requiring bills to be read on three several
 2-2     days in each house be suspended, and this rule is hereby suspended,
 2-3     and that this Act take effect and be in force from and after its
 2-4     passage, and it is so enacted.
 2-5           Explanation:  This change is necessary to require a school
 2-6     district to provide a copy of an individualized education program
 2-7     in Spanish if a parent's native language is Spanish, and to
 2-8     require, if a parent's native language is a language other than
 2-9     Spanish, a good faith effort to provide the copy in that language.
