                                 R E S O L U T I O N
 1-1           BE IT RESOLVED by the House of Representatives of the State
 1-2     of Texas, 76th Legislature, Regular Session, 1999, That House Rule
 1-3     13, Section 9(a), be suspended in part as provided by House Rule
 1-4     13, Section 9(f), to enable the conference committee appointed to
 1-5     resolve the differences between the house and senate versions of
 1-6     H.B. No. 3328, relating to speed limits on highways of this state,
 1-7     to consider and take action on the following matters:
 1-8           (1)  House Rule 13, Section 9(a)(2), is suspended to permit
 1-9     the committee to omit from SECTION 1 of the bill the amendment of
1-10     Section 545.352(b), Transportation Code.
1-11           Explanation:  This change is necessary to retain the limits
1-12     currently set by Section 545.352(b)(2), Transportation Code.
1-13           (2)  House Rule 13, Sections (9)(a)(1), (3), and (4), are
1-14     suspended to permit the committee to change and add text in SECTION
1-15     1 of the bill, by changing Section 545.352(e), Transportation Code,
1-16     as added by the bill,  to read as follows:
1-17           (e)  Notwithstanding Subsection (b), in a county having a
1-18     population of less than 25,000, on a highway or portion of a
1-19     highway numbered by this state or the United States that is outside
1-20     an urban district, other than a farm-to-market or ranch-to-market
1-21     road, and that on August 31, 1999, had a maximum prima facie speed
1-22     limit of 70 miles per hour in the daytime and 65 miles per hour in
1-23     the nighttime, 75 miles per hour is lawful if:
1-24                 (1)  the vehicle is a vehicle other than a school bus;
 2-1     and
 2-2                 (2)  the commission determines that 75 miles per hour
 2-3     is reasonable and prudent on that highway or portion of that
 2-4     highway.
 2-5           Explanation:  This change is necessary to allow only vehicles
 2-6     in a county with a population of less than 25,000 to travel 75
 2-7     miles per hour.  It also codifies the provision allowing the
 2-8     commission to determine if an increased speed limit is appropriate.
 2-9           (3)  House Rule 13, Section 9(a)(2), is suspended to permit
2-10     the committee to omit the following phrase in SECTION 2 of the
2-11     bill, in Section 545.353(d)(2), Transportation Code:  "except as
2-12     provided by Section 545.352(e)".
2-13           Explanation:  The omitted phrase is no longer necessary.
2-14           (4)  House Rule 13, Section 9(a)(2), is suspended to permit
2-15     the committee to omit that part of the text in SECTION 3 of the
2-16     bill that is common to both the house and senate versions and that
2-17     reads:
2-18           Notwithstanding the change in law made by this Act, on a
2-19     highway or portion of a highway that on the effective date of this
2-20     Act has a speed limit of 70 miles per hour in daytime and 65 miles
2-21     per hour in nighttime, the speed limit may be increased as provided
2-22     by this Act only if the Texas Department of Transportation
2-23     determines that the increase is appropriate on that highway or
2-24     portion of highway.
2-25           Explanation:  The new Section 545.352(e), Transportation
2-26     Code, as added by the conference committee report, incorporates
2-27     this provision.
