                                 R E S O L U T I O N
 1-1           BE IT RESOLVED by the House of Representatives of the State
 1-2     of Texas, 76th Legislature, Regular Session, 1999, That House Rule
 1-3     13, Section 9(a), be suspended in part as provided by House Rule
 1-4     13, Section 9(f), to enable the conference committee appointed to
 1-5     resolve the differences on House Bill No. 1059, relating to the
 1-6     regulation of amusement rides, to consider and take action on the
 1-7     following matters:
 1-8           (1)  House Rule 13, Sections 9(a)(1), (2), (3), and (4), are
 1-9     suspended to permit the committee to modify the existing text and
1-10     add additional text, in Section 3 of the bill, to added Section
1-11     4(d), Article  21.60, Insurance Code, to read as follows:
1-12           (d)  A person who operates an amusement ride in this state
1-13     shall maintain accurate records of any governmental action taken in
1-14     any state relating to that particular amusement ride, including an
1-15     inspection resulting in the repair or replacement of equipment used
1-16     in the operation of the amusement ride.  The operator shall file
1-17     with the commissioner on a quarterly basis a report on a form
1-18     designed by the commissioner describing each governmental action
1-19     taken in the quarter covered by the report for which the operator
1-20     is required by this subsection to maintain records. A report is not
1-21     required under this section in any quarter in which no reportable
1-22     governmental action was taken in any state in which the person
1-23     operated the amusement ride.
1-24           Explanation:  This change is necessary to clarify that
 2-1     records of governmental actions are required to be maintained only
 2-2     for the specific amusement ride against which the actions are taken
 2-3     rather than for all amusement rides of a particular classification.
 2-4           (2)  House Rule 13, Sections 9(a)(1), (3), and (4), are
 2-5     suspended to permit the committee to modify the existing text and
 2-6     add additional text, in Section 6 of the bill, to amended Section
 2-7     9(a), Article  21.60, Insurance Code, to read as follows:
 2-8           (a)  A person commits an offense if the person [he] fails to
 2-9     comply with any requirement under Section 4, [or] 5, 10(e), 10(f),
2-10     10(g), or 10(k) of this article or under any rule adopted by the
2-11     commissioner under Section 4 of this article.
2-12           Explanation:  This change is necessary to create a criminal
2-13     offense for operating an amusement ride after a death has occurred
2-14     on the ride.
