                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to benefits payable by the Judicial Retirement System of
 1-2     Texas Plan Two.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subsections (a) and (c), Section 839.102,
 1-5     Government Code, are amended to read as follows:
 1-6           (a)  Except as provided by Subsections (b) and (c), the
 1-7     standard service retirement annuity is an amount equal to 50
 1-8     percent of the state salary, as adjusted from time to time, being
 1-9     paid [at the time the member retires] to a judge of a court of the
1-10     same classification as the last court to which the retiring member
1-11     was elected or appointed.
1-12           (c)  The standard service retirement annuity of a person
1-13     qualifying for retirement under Section 839.101(b) is an amount
1-14     computed as a percentage of the state salary, as adjusted from time
1-15     to time, being paid [at the time the member retires] to a judge of
1-16     a court of the same classification as the last court to which the
1-17     retiring member was elected or appointed, according to the
1-18     following schedule:
1-19          age at retirement           percentage of state salary
1-20     at least 60 but less than 61         40     percent
1-21     at least 61 but less than 62         41.7   percent
1-22     at least 62 but less than 63         43.6   percent
1-23     at least 63 but less than 64         45.6   percent
1-24     at least 64 but less than 65         47.7   percent.
 2-1           SECTION 2.  (a)  This Act takes effect September 1, 2001, if
 2-2     the comptroller of public accounts of the State of Texas
 2-3     determines, after consultation with the actuary for the Employees
 2-4     Retirement System of Texas, that implementation of the change in
 2-5     law made by this Act would not necessitate additional state
 2-6     contributions for the Judicial Retirement System of Texas Plan Two
 2-7     to remain in compliance with Section 840.106, Government Code.  The
 2-8     comptroller may also make the determination earlier, in which case
 2-9     the effective date of this Act is the date of the earlier
2-10     determination.  If the comptroller makes a determination under this
2-11     subsection, the comptroller shall file notice of the determination
2-12     with the secretary of state for publication in the Texas Register.
2-13           (b)  The change in law made by this Act to Section 839.102,
2-14     Government Code, applies to all annuities that become payable under
2-15     Subtitle E, Title 8, Government Code, on or after the effective
2-16     date of this Act.
2-17           SECTION 3.  The importance of this legislation and the
2-18     crowded condition of the calendars in both houses create an
2-19     emergency and an imperative public necessity that the
2-20     constitutional rule requiring bills to be read on three several
2-21     days in each house be suspended, and this rule is hereby suspended.
