1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to benefits payable by the Judicial Retirement System of
1-11 Texas Plan Two.
1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13 SECTION 1. Subsections (a) and (c), Section 839.102,
1-14 Government Code, are amended to read as follows:
1-15 (a) Except as provided by Subsections (b) and (c), the
1-16 standard service retirement annuity is an amount equal to 50
1-17 percent of the state salary, as adjusted from time to time, being
1-18 paid [at the time the member retires] to a judge of a court of the
1-19 same classification as the last court to which the retiring member
1-20 was elected or appointed.
1-21 (c) The standard service retirement annuity of a person
1-22 qualifying for retirement under Section 839.101(b) is an amount
1-23 computed as a percentage of the state salary, as adjusted from time
1-24 to time, being paid [at the time the member retires] to a judge of
1-25 a court of the same classification as the last court to which the
1-26 retiring member was elected or appointed, according to the
1-27 following schedule:
1-28 age at retirement percentage of state salary
1-29 at least 60 but less than 61 40 percent
1-30 at least 61 but less than 62 41.7 percent
1-31 at least 62 but less than 63 43.6 percent
1-32 at least 63 but less than 64 45.6 percent
1-33 at least 64 but less than 65 47.7 percent.
1-34 SECTION 2. (a) This Act takes effect September 1, 2001, if
1-35 the comptroller of public accounts of the State of Texas
1-36 determines, after consultation with the actuary for the Employees
1-37 Retirement System of Texas, that implementation of the change in
1-38 law made by this Act would not necessitate additional state
1-39 contributions for the Judicial Retirement System of Texas Plan Two
1-40 to remain in compliance with Section 840.106, Government Code. The
1-41 comptroller may also make the determination earlier, in which case
1-42 the effective date of this Act is the date of the earlier
1-43 determination. If the comptroller makes a determination under this
1-44 subsection, the comptroller shall file notice of the determination
1-45 with the secretary of state for publication in the Texas Register.
1-46 (b) The change in law made by this Act to Section 839.102,
1-47 Government Code, applies to all annuities that become payable under
1-48 Subtitle E, Title 8, Government Code, on or after the effective
1-49 date of this Act.
1-50 SECTION 3. The importance of this legislation and the
1-51 crowded condition of the calendars in both houses create an
1-52 emergency and an imperative public necessity that the
1-53 constitutional rule requiring bills to be read on three several
1-54 days in each house be suspended, and this rule is hereby suspended.
