A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to salaries of public school classroom teachers and
1-3 librarians.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 21.402, Education Code, is amended to
1-6 read as follows:
1-7 Sec. 21.402. MINIMUM SALARY SCHEDULE FOR CLASSROOM TEACHERS
1-8 AND FULL-TIME LIBRARIANS. (a) Except as provided by Subsection
1-9 [(d) or] (e) or (f), a school district must pay each classroom
1-10 teacher or full-time librarian not less than the minimum monthly
1-11 salary, based on the employee's level of experience, determined by
1-12 the following formula:
1-13 MS = SF X (FSP/ADA)
1-14 where:
1-15 "MS" is the minimum monthly salary;
1-16 "SF" is the applicable salary factor specified by Subsection
1-17 (c) or computed under Subsection (d), as applicable;
1-18 "FSP" is the amount appropriated in the General
1-19 Appropriations Act for the fiscal year for the Foundation School
1-20 Program, as determined by the commissioner as provided by
1-21 Subsection (b); and
1-22 "ADA" is the total estimated average daily attendance, as
1-23 defined by Section 42.005, used for purposes of the General
1-24 Appropriations Act for the fiscal year.
2-1 (a-1) Notwithstanding Subsection (a), for the [1997-1998
2-2 and] 1998-1999 school year [years], "FSP" for purposes of
2-3 Subsection (a):
2-4 (1) includes amounts appropriated in H.B. No. 4, Acts
2-5 of the 75th Legislature, Regular Session, 1997; and
2-6 (2) does not include the following amounts
2-7 appropriated in H.B. No. 1, Acts of the 75th Legislature, Regular
2-8 Session, 1997:
2-9 (A) amounts appropriated under Rider 73
2-10 following appropriations to the Texas Education Agency in Article
2-11 III of that Act; or
2-12 (B) amounts appropriated under Section 198 of
2-13 Article IX of that Act.
2-14 (a-2) Subsection (a-1) and this subsection expire September
2-15 1, 1999.
2-16 (b) Not later than June 1 of each year, the commissioner
2-17 shall determine the amount appropriated for purposes of Chapter 42
2-18 for the state fiscal year beginning September 1. The commissioner
2-19 shall exclude from the determination:
2-20 (1) amounts designated solely for use in connection
2-21 with school facilities or for payment of principal of and interest
2-22 on bonds; and
2-23 (2) local funds received under Subchapter D, Chapter
2-24 41.
2-25 (c) The salary factors per step for teachers or librarians
2-26 with 20 years of experience or less are as follows:

3-10 (d) The salary factor per step for each teacher or librarian
3-11 with more than 20 years of experience is the sum of the salary
3-12 factor for step 20 prescribed by Subsection (c) plus the product of
3-13 the number of the teacher's or librarian's years of experience
3-14 beyond 20 years of experience multiplied by 0.0216.
3-15 (e) If the minimum monthly salary determined under
3-16 Subsection (a) for a particular level of experience is less than
3-17 the minimum monthly salary for that level of experience in the
3-18 preceding year, the minimum monthly salary is the minimum monthly
3-19 salary for the preceding year.
3-20 (f) [(e)] Notwithstanding Subsection (a), a teacher or
3-21 librarian who received a career ladder supplement on August 31,
3-22 1993, is entitled to at least the same gross monthly salary the
3-23 teacher or librarian received for the 1994-1995 school year as long
3-24 as the teacher or librarian is employed by the same district.
3-25 (g) [(f)] In this section, "gross monthly salary" must
3-26 include the amount a teacher or librarian received that represented
3-27 a career ladder salary supplement under Section 16.057, as that
4-1 section existed January 1, 1993.
4-2 SECTION 2. This Act applies beginning with the 1999-2000
4-3 school year.
4-4 SECTION 3. The importance of this legislation and the
4-5 crowded condition of the calendars in both houses create an
4-6 emergency and an imperative public necessity that the
4-7 constitutional rule requiring bills to be read on three several
4-8 days in each house be suspended, and this rule is hereby suspended,
4-9 and that this Act take effect and be in force from and after its
4-10 passage, and it is so enacted.
