AN ACT
1-1 relating to the modification of certain child support orders.
1-2 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-3 SECTION 1. Section 156.401, Family Code, is amended by
1-4 adding Subsection (d) to read as follows:
1-5 (d) Release of a child support obligor from incarceration is
1-6 a material and substantial change in circumstances for purposes of
1-7 Subsection (a)(1) if the obligor's child support obligation was
1-8 abated, reduced, or suspended during the period of the obligor's

1-10 SECTION 2. This Act takes effect September 1, 1999, and
1-11 applies to a child support order entered before, on, or after that
1-12 date.
1-13 SECTION 3. The importance of this legislation and the
1-14 crowded condition of the calendars in both houses create an
1-15 emergency and an imperative public necessity that the
