A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to continuing education requirements for auctioneers and
1-3 associate auctioneers.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 3B, Chapter 320, Acts of the 64th
1-6 Legislature, Regular Session, 1975 (Article 8700, Vernon's Texas
1-7 Civil Statutes), is amended to read as follows:
1-8 Sec. 3B. CONTINUING EDUCATION PROGRAMS. (a) To renew a
1-9 license issued under this Act, a person must complete annually at
1-10 least seven hours of continuing education in programs approved by
1-11 the commissioner in the field of auctioneering.
1-12 (b) A person applying to renew a license issued under this
1-13 Act must provide to the commissioner proof that the person has
1-14 completed the continuing education requirement of this section.
1-15 (c) The commissioner shall adopt rules under this section
1-16 for approval of continuing education programs. [The commissioner
1-17 may recognize, prepare, or administer continuing education programs
1-18 for licensees. Participation in the programs is voluntary.]
1-19 SECTION 2. (a) Except as provided by Subsections (b) and
1-20 (c) of this section, this Act takes effect September 1, 1999.
1-21 (b) Section 3B(b), Chapter 320, Acts of the 64th
1-22 Legislature, Regular Session, 1975 (Article 8700, Vernon's Texas
1-23 Civil Statutes), as added by this Act, applies only to a person who
1-24 files an application to renew an auctioneer's or associate
2-1 auctioneer's license on or after September 1, 2000.
2-2 (c) The commissioner of licensing and regulation shall adopt
2-3 rules under Section 3B(c), Chapter 320, Acts of the 64th
2-4 Legislature, Regular Session, 1975 (Article 8700, Vernon's Texas
2-5 Civil Statutes), as added by this Act, not later than March 1,
2-6 2000.
2-7 SECTION 3. The importance of this legislation and the
2-8 crowded condition of the calendars in both houses create an
2-9 emergency and an imperative public necessity that the
2-10 constitutional rule requiring bills to be read on three several
2-11 days in each house be suspended, and this rule is hereby suspended.
