                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the computation of average daily attendance in certain
 1-3     school districts that experience a decline in attendance.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 42.005(b), Education Code, is amended to
 1-6     read as follows:
 1-7           (b)  A school district that experiences a decline of two
 1-8     percent or more in average daily attendance as a result of factors
 1-9     beyond the control of the district [the closing or reduction in
1-10     personnel of a military base] shall be funded on the basis of the
1-11     actual average daily attendance of the preceding school year.  For
1-12     purposes of this section, factors beyond the control of a district
1-13     include:
1-14                 (1)  the closing or reduction in personnel of a
1-15     military base;
1-16                 (2)  the closing or reduction in personnel of a major
1-17     employer;
1-18                 (3)  the closing of a significant residential housing
1-19     facility in the district;
1-20                 (4)  the introduction of a program to assist district
1-21     students in attending private school; or
1-22                 (5)  a natural disaster that results in families
1-23     leaving the district.
1-24           SECTION 2.  This Act takes effect September 1, 1999.
 2-1           SECTION 3.  The importance of this legislation and the
 2-2     crowded condition of the calendars in both houses create an
 2-3     emergency and an imperative public necessity that the
 2-4     constitutional rule requiring bills to be read on three several
 2-5     days in each house be suspended, and this rule is hereby suspended.
