AN ACT
1-1 relating to facilities and functions of facilities under the
1-2 jurisdiction of the Texas Department of Mental Health and Mental
1-3 Retardation.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subsection (b), Section 532.001, Health and
1-6 Safety Code, is amended to read as follows:
1-7 (b) The department also includes community services operated
1-8 by the department and the following facilities:
1-9 (1) the central office of the department;
1-10 (2) the Austin State Hospital;
1-11 (3) the Big Spring State Hospital;
1-12 (4) the Kerrville State Hospital;
1-13 (5) the Rusk State Hospital;
1-14 (6) the San Antonio State Hospital;
1-15 (7) the Terrell State Hospital;
1-16 (8) the North Texas [Vernon-Wichita Falls] State
1-17 Hospital;
1-18 (9) the Abilene State School;
1-19 (10) the Austin State School;
1-20 (11) the Brenham State School;
1-21 (12) the Corpus Christi State School;
1-22 (13) the Denton State School;
1-23 (14) the Lubbock State School;
1-24 (15) the Lufkin State School;
2-1 (16) the Mexia State School;
2-2 (17) the Richmond State School;
2-3 (18) the San Angelo State School;
2-4 (19) the San Antonio State School;
2-5 (20) the Amarillo State Center;
2-6 (21) the Beaumont State Center;
2-7 (22) the El Paso State Center;
2-8 (23) [the Harris County Psychiatric Center;]
2-9 [(24)] the Laredo State Center;
2-10 (24) [(25)] the Rio Grande State Center; and
2-11 (25) [(26)] the Waco Center for Youth[;]
2-12 [(27) the Dallas Mental Health Connections;]
2-13 [(28) the El Paso Psychiatric Hospital; and]
2-14 [(29) the Lubbock Psychiatric Hospital].
2-15 SECTION 2. Subdivision (21), Section 571.003, Health and
2-16 Safety Code, is amended to read as follows:
2-17 (21) "State mental hospital" means[:]
2-18 [(A)] a mental hospital operated by the
2-19 department[; or]
2-20 [(B) an inpatient mental health facility that is
2-21 included in Section 532.001(b)].
2-22 SECTION 3. Section 574.041, Health and Safety Code, is
2-23 amended by amending Subsection (a) and adding Subsection (d) to
2-24 read as follows:
2-25 (a) In an order for temporary or extended mental health
2-26 services specifying inpatient care, the court shall commit the
3-1 patient to a designated mental health facility. The court shall
3-2 commit the patient to:
3-3 (1) a [the] facility of a single portal authority for
3-4 the area, if an authority has been designated for the area;
3-5 (2) a private mental hospital under Section 574.042;
3-6 (3) a hospital operated by a federal agency under
3-7 Section 574.043; or
3-8 (4) an inpatient mental health facility of the
3-9 institutional division of the Texas Department of Criminal Justice
3-10 under Section 574.044.
3-11 (d) In this section, "facility of a single portal authority"
3-12 includes a private mental hospital under contract with a single
3-13 portal authority.
3-14 SECTION 4. Chapter 596, Health and Safety Code, is repealed.
3-15 SECTION 5. The importance of this legislation and the
3-16 crowded condition of the calendars in both houses create an
3-17 emergency and an imperative public necessity that the
3-18 constitutional rule requiring bills to be read on three several
3-19 days in each house be suspended, and this rule is hereby suspended,
3-20 and that this Act take effect and be in force from and after its
3-21 passage, and it is so enacted.
