1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to facilities and functions of facilities under the
1-11 jurisdiction of the Texas Department of Mental Health and Mental
1-12 Retardation.
1-13 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-14 SECTION 1. Subsection (b), Section 532.001, Health and
1-15 Safety Code, is amended to read as follows:
1-16 (b) The department also includes community services operated
1-17 by the department and the following facilities:
1-18 (1) the central office of the department;
1-19 (2) the Austin State Hospital;
1-20 (3) the Big Spring State Hospital;
1-21 (4) the Kerrville State Hospital;
1-22 (5) the Rusk State Hospital;
1-23 (6) the San Antonio State Hospital;
1-24 (7) the Terrell State Hospital;
1-25 (8) the North Texas [Vernon-Wichita Falls] State
1-26 Hospital;
1-27 (9) the Abilene State School;
1-28 (10) the Austin State School;
1-29 (11) the Brenham State School;
1-30 (12) the Corpus Christi State School;
1-31 (13) the Denton State School;
1-32 (14) the Lubbock State School;
1-33 (15) the Lufkin State School;
1-34 (16) the Mexia State School;
1-35 (17) the Richmond State School;
1-36 (18) the San Angelo State School;
1-37 (19) the San Antonio State School;
1-38 (20) the Amarillo State Center;
1-39 (21) the Beaumont State Center;
1-40 (22) the El Paso State Center;
1-41 (23) [the Harris County Psychiatric Center;]
1-42 [(24)] the Laredo State Center;
1-43 (24) [(25)] the Rio Grande State Center; and
1-44 (25) [(26)] the Waco Center for Youth[;]
1-45 [(27) the Dallas Mental Health Connections;]
1-46 [(28) the El Paso Psychiatric Hospital; and]
1-47 [(29) the Lubbock Psychiatric Hospital].
1-48 SECTION 2. Subdivision (21), Section 571.003, Health and
1-49 Safety Code, is amended to read as follows:
1-50 (21) "State mental hospital" means[:]
1-51 [(A)] a mental hospital operated by the
1-52 department[; or]
1-53 [(B) an inpatient mental health facility that is
1-54 included in Section 532.001(b)].
1-55 SECTION 3. Section 574.041, Health and Safety Code, is
1-56 amended by amending Subsection (a) and adding Subsection (d) to
1-57 read as follows:
1-58 (a) In an order for temporary or extended mental health
1-59 services specifying inpatient care, the court shall commit the
1-60 patient to a designated mental health facility. The court shall
1-61 commit the patient to:
1-62 (1) a [the] facility of a single portal authority for
1-63 the area, if an authority has been designated for the area;
1-64 (2) a private mental hospital under Section 574.042;
2-1 (3) a hospital operated by a federal agency under
2-2 Section 574.043; or
2-3 (4) an inpatient mental health facility of the
2-4 institutional division of the Texas Department of Criminal Justice
2-5 under Section 574.044.
2-6 (d) In this section, "facility of a single portal authority"
2-7 includes a private mental hospital under contract with a single
2-8 portal authority.
2-9 SECTION 4. Chapter 596, Health and Safety Code, is repealed.
2-10 SECTION 5. The importance of this legislation and the
2-11 crowded condition of the calendars in both houses create an
2-12 emergency and an imperative public necessity that the
2-13 constitutional rule requiring bills to be read on three several
2-14 days in each house be suspended, and this rule is hereby suspended,
2-15 and that this Act take effect and be in force from and after its
2-16 passage, and it is so enacted.
