                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the use by political subdivisions that receive state
 1-3     financial assistance for water supply and sewer projects in
 1-4     economically distressed areas of the revenue received from those
 1-5     projects.
 1-6           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-7           SECTION 1.  Subchapter J, Chapter 16, Water Code, is amended
 1-8     by adding Section 16.352 to read as follows:
 1-9           Sec. 16.352.  USE OF REVENUE FROM WATER SUPPLY OR SEWER
1-10     PROJECTS.  (a)  A political subdivision that receives financial
1-11     assistance under Subchapter K, Chapter 17, that is required to be
1-12     repaid may use the  revenue received from a water supply or sewer
1-13     project constructed with the financial assistance only for utility
1-14     purposes until the financial assistance is repaid.
1-15           (b)  At the request of the board or on the attorney general's
1-16     own initiative, the attorney general may file suit to enjoin an
1-17     actual or threatened violation of this section.
1-18           SECTION 2.  The importance of this legislation and the
1-19     crowded condition of the calendars in both houses create an
1-20     emergency and an imperative public necessity that the
1-21     constitutional rule requiring bills to be read on three several
1-22     days in each house be suspended, and this rule is hereby suspended,
1-23     and that this Act take effect and be in force from and after its
1-24     passage, and it is so enacted.
