                                A BILL TO BE ENTITLED
                                       AN ACT
1-1 relating to a disqualification for receipt of unemployment
1-2 compensation benefits for a benefit period in which the applicant
1-3 for benefits works at least 40 hours.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Section 201.091, Labor Code, is amended by adding
1-6 Subsection (e) to read as follows:
1-7 (e) For purposes of this subtitle, an individual is not
1-8 considered unemployed and is not eligible to receive benefits for
1-9 any benefit period in which the individual works at least 40 hours,
1-10 regardless of the amount of wages the individual earns during the
1-11 benefit period.
1-12 SECTION 2. This Act takes effect September 1, 1999, and
1-13 applies only to a claim for unemployment compensation benefits that
1-14 is filed with the Texas Workforce Commission on or after that date.
1-15 A claim filed before that date is governed by the law in effect on
1-16 the date that the claim was filed, and the former law is continued
1-17 in effect for that purpose.
1-18 SECTION 3. The importance of this legislation and the
1-19 crowded condition of the calendars in both houses create an
1-20 emergency and an imperative public necessity that the
1-21 constitutional rule requiring bills to be read on three several
1-22 days in each house be suspended, and this rule is hereby suspended.
