1-8 A BILL TO BE ENTITLED
1-9 AN ACT
1-10 relating to the statutory courts of Denton County.
1-11 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-12 SECTION 1. Subsection (a), Section 25.0631, Government Code,
1-13 is amended to read as follows:
1-14 (a) Denton County has the following statutory county courts:
1-15 (1) County Court at Law No. 1 of Denton County;
1-16 (2) County Criminal Court No. 1 of Denton County;
1-17 (3) County Criminal Court No. 2 of Denton County;
1-18 (4) County Criminal Court No. 3 of Denton County;
1-19 [and]
1-20 (5) County Criminal Court No. 4 of Denton County; and
1-21 (6) County Criminal Court No. 5 of Denton County.
1-22 SECTION 2. Section 25.0632, Government Code, is amended by
1-23 adding Subsection (j) to read as follows:
1-24 (j) Section 25.0006 does not apply to a statutory county
1-25 court in Denton County.
1-26 SECTION 3. Subsection (c), Section 25.0633, Government Code,
1-27 is amended to read as follows:
1-28 (c) Notwithstanding Section 25.0003, the County Court at Law
1-29 No. 1 of Denton County does not have jurisdiction over [civil,
1-30 civil appellate,] probate[,] or mental health matters or over
1-31 family law cases and proceedings other than juvenile proceedings.
1-32 SECTION 4. Subsection (b), Section 25.0634, Government Code,
1-33 is amended to read as follows:
1-34 (b) A county criminal court has no jurisdiction over [civil,
1-35 civil appellate,] probate[,] or mental health matters.
1-36 SECTION 5. (a) The County Criminal Court No. 5 of Denton
1-37 County is created October 1, 2000.
1-38 (b) Except as provided by Subsection (c) of this section,
1-39 this Act takes effect October 1, 2000.
1-40 (c) Sections 25.0633 and 25.0634, Government Code, as
1-41 amended by Sections 3 and 4 of this Act, take effect September 1,
1-42 1999, but only if S.B. No. 1163, Acts of the 76th Legislature,
1-43 Regular Session, 1999, is enacted and becomes law. If S.B. No.
1-44 1163, Acts of the 76th Legislature, Regular Session, 1999, does not
1-45 become law, Sections 3 and 4 of this Act have no effect.
1-46 SECTION 6. The importance of this legislation and the
1-47 crowded condition of the calendars in both houses create an
1-48 emergency and an imperative public necessity that the
1-49 constitutional rule requiring bills to be read on three several
1-50 days in each house be suspended, and this rule is hereby suspended.
