No. 383 By: Duncan 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to access to criminal history record information by a 1-11 political subdivision for certain background checks. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Subsection (a), Section 411.124, Government Code, 1-14 is amended to read as follows: 1-15 (a) A political subdivision of this state that employs, 1-16 licenses, or regulates drivers of public transportation vehicles is 1-17 entitled to obtain from the department or from a law enforcement 1-18 agency of the political subdivision with access to the information 1-19 the criminal history record information maintained by the 1-20 department that relates to a person who is: 1-21 (1) the driver of a public transportation vehicle; and 1-22 (2) employed, licensed, or regulated by the political 1-23 subdivision. 1-24 SECTION 2. The importance of this legislation and the 1-25 crowded condition of the calendars in both houses create an 1-26 emergency and an imperative public necessity that the 1-27 constitutional rule requiring bills to be read on three several 1-28 days in each house be suspended, and this rule is hereby suspended, 1-29 and that this Act take effect and be in force from and after its 1-30 passage, and it is so enacted. 1-31 * * * * *
