A BILL TO BE ENTITLED
AN ACT
1-1 relating to the purchase of library materials by certain
1-2 institutions of higher education with constitutional funds.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subsection (a), Section 62.021, Education Code,
1-5 is amended to read as follows:
1-6 (a) Each fiscal year, an eligible institution is entitled to
1-7 receive an amount allocated in accordance with this section from
1-8 funds appropriated by Article VII, Section 17(a), of the
1-9 Constitution of Texas. The comptroller of public accounts shall
1-10 distribute funds allocated under this subsection only on
1-11 presentation of a claim and issuance of a warrant in accordance
1-12 with Section 403.071, Government Code. The comptroller may not
1-13 issue a warrant from any funds allocated under this subsection
1-14 before the delivery of goods or services described in Section 17,
1-15 Article VII, Texas Constitution, except for the payment of
1-16 principal or interest on bonds or notes or the purchase of books
1-17 and other published library materials as provided by Section
1-18 2155.386, Government Code. The allocation of funds under this
1-19 subsection is made in accordance with an equitable formula
1-20 consisting of the following elements: space deficit, facilities
1-21 condition, institutional complexity, separate allocations for
1-22 medical units and the Texas State Technical College System, and an
1-23 additional allocation for Texas Southern University for compliance
1-24 with the Texas Desegregation Plan. The amounts allocated by the
2-1 formula are as follows:

3-16 SECTION 2. The importance of this legislation and the
3-17 crowded condition of the calendars in both houses create an
3-18 emergency and an imperative public necessity that the
3-19 constitutional rule requiring bills to be read on three several
3-20 days in each house be suspended, and this rule is hereby suspended,
3-21 and that this Act take effect and be in force from and after its
3-22 passage, and it is so enacted.
