 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the timing of an application for a solid waste permit.
 1-9           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-10           SECTION 1.  Section 361.066, Health and Safety Code, is
1-11     amended by amending Subsection (a)  and adding Subsection (c) to
1-12     read as follows:
1-13           (a)  An applicant must submit any portion of an application
1-14     that the commission determines is necessary to make the application
1-15     administratively complete not later than the deadline set by the
1-16     commission under Subsection (c) [270th day after the applicant
1-17     receives notice from the commission that the additional information
1-18     or material is needed].
1-19           (c)  The commission by rule shall establish a deadline for
1-20     the submission of additional information or material after the
1-21     applicant receives notice from the commission that the information
1-22     or material is needed to make the application administratively
1-23     complete.
1-24           SECTION 2.  (a)  This Act takes effect September 1, 1999.
1-25           (b)  Subsections (a) and (c), Section 361.066, Health and
1-26     Safety Code, as amended and added by this Act, apply only to an
1-27     application submitted on or after the effective date of this Act.
1-28           SECTION 3.  The importance of this legislation and the
1-29     crowded condition of the calendars in both houses create an
1-30     emergency and an imperative public necessity that the
1-31     constitutional rule requiring bills to be read on three several
1-32     days in each house be suspended, and this rule is hereby suspended.
