A BILL TO BE ENTITLED
1-1 AN ACT
1-2 relating to classification of the position of fire marshal in
1-3 certain municipal fire departments.
1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-5 SECTION 1. Subchapter G, Chapter 143, Local Government Code,
1-6 is amended by adding Section 143.1025 to read as follows:
1-7 Sec. 143.1025. CLASSIFICATION OF FIRE MARSHAL. (a) In
1-8 addition to other fire fighter classifications created in
1-9 accordance with Section 143.021, the municipality's governing body
1-10 shall establish the classification of fire marshal by ordinance.
1-11 (b) The classified position of fire marshal may only be
1-12 filled from an eligibility list that results from an examination
1-13 held in accordance with this chapter.
1-14 (c) The failure of the governing body to establish the fire
1-15 marshal position by ordinance does not result in the loss of civil
1-16 service benefits by a person entitled to civil service protection
1-17 or appointed to the position in substantial compliance with this
1-18 chapter.
1-19 SECTION 2. The importance of this legislation and the
1-20 crowded condition of the calendars in both houses create an
1-21 emergency and an imperative public necessity that the
1-22 constitutional rule requiring bills to be read on three several
1-23 days in each house be suspended, and this rule is hereby suspended,
1-24 and that this Act take effect and be in force from and after its
2-1 passage, and it is so enacted.
