No. 591 76R6200 ESH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to funding for school districts that open new schools or 1-3 expand existing schools. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter C, Chapter 42, Education Code, is 1-6 amended by adding Section 42.158 to read as follows: 1-7 Sec. 42.158. NEW OR EXPANDED INSTRUCTIONAL FACILITY 1-8 ALLOTMENT. (a) A school district is entitled to an additional 1-9 allotment as provided by this section for operational expenses 1-10 associated with opening a new instructional facility or expanding 1-11 an existing instructional facility. 1-12 (b) For the first school year in which students attend a new 1-13 instructional facility, a school district is entitled to an 1-14 allotment of $500 for each student in weighted average daily 1-15 attendance at the facility. For the second school year in which 1-16 students attend that instructional facility, a school district is 1-17 entitled to an allotment of $500 for each additional student in 1-18 weighted average daily attendance at the facility. 1-19 (c) For the first year that begins following an expansion of 1-20 instructional space in an existing instructional facility that is 1-21 designed to accommodate an increase of at least 10 percent in the 1-22 number of students in weighted average daily attendance at that 1-23 facility, a district is entitled to an allotment of $250 for each 1-24 additional student in weighted average daily attendance at that 2-1 facility. 2-2 (d) For purposes of this section: 2-3 (1) the number of students in weighted average daily 2-4 attendance at an instructional facility is determined by dividing 2-5 the number of students in average daily attendance at the facility 2-6 by the quotient of the number of students in average daily 2-7 attendance in the district divided by the number of students in 2-8 weighted average daily attendance, as computed under Section 2-9 42.302, in the district; and 2-10 (2) the number of additional students in weighted 2-11 average daily attendance at a facility is the difference between 2-12 the number of students in weighted average daily attendance in the 2-13 current year at that facility and the number of students in 2-14 weighted average daily attendance at that facility in the preceding 2-15 year. 2-16 (e) The commissioner may adopt rules necessary to implement 2-17 this section. 2-18 (f) In this section, "instructional facility" has the 2-19 meaning assigned by Section 46.001. 2-20 SECTION 2. This Act takes effect September 1, 1999. 2-21 SECTION 3. The importance of this legislation and the 2-22 crowded condition of the calendars in both houses create an 2-23 emergency and an imperative public necessity that the 2-24 constitutional rule requiring bills to be read on three several 2-25 days in each house be suspended, and this rule is hereby suspended.
