No. 596 99S0464/1 A BILL TO BE ENTITLED AN ACT 1-1 relating to an additional Foundation School Program allotment for 1-2 schools that open or expand instructional facilities. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. Subchapter B, Chapter 42, Education Code, is 1-5 amended by adding Section 42.106 to read as follows: 1-6 Sec. 42.106. INSTRUCTIONAL FACILITIES OPENING OR EXPANSION 1-7 ADJUSTMENT. (a) A district is entitled to an additional allotment 1-8 for operational expenses associated with opening a new or expanding 1-9 an existing instructional facility. In this section, 1-10 "instructional facility" has the same meaning assigned by Section 1-11 46.001. 1-12 (b) For the year in which a district opens a new 1-13 instructional facility, the district shall receive an additional 1-14 allotment of $500 per student in weighted average daily attendance 1-15 at that facility. For the second year after a district opens a new 1-16 instructional facility, the district shall receive an additional 1-17 allotment of $500 per student in weighted average daily attendance 1-18 at that facility in excess of the number of students in weighted 1-19 average daily attendance at the facility for the preceding year. 1-20 (c) For the year in which a district expands the 1-21 instructional space at an existing instructional facility to 1-22 accommodate an increase of 10 percent or more in the number of 1-23 students in weighted average daily attendance at that facility, the 1-24 district shall receive an additional allotment of $250 per student 2-1 in weighted average daily attendance at the facility in excess of 2-2 the number of students in weighted average daily attendance at the 2-3 facility for the preceding year. 2-4 (d) The commissioner may adopt rules necessary for the 2-5 implementation of this section. 2-6 SECTION 2. This Act takes effect September 1, 1999. 2-7 SECTION 3. The importance of this legislation and the 2-8 crowded condition of the calendars in both houses create an 2-9 emergency and an imperative public necessity that the 2-10 constitutional rule requiring bills to be read on three several 2-11 days in each house be suspended, and this rule is hereby suspended.
