No. 630 76R5148 SMH-D A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the use by political subdivisions that receive state 1-3 financial assistance for water supply and sewer service projects in 1-4 economically distressed areas of the revenue from the operation of 1-5 those projects. 1-6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-7 SECTION 1. Subchapter J, Chapter 16, Water Code, is amended 1-8 by adding Section 16.352 to read as follows: 1-9 Sec. 16.352. USE OF REVENUE FROM OPERATION OF WATER SUPPLY 1-10 OR SEWER SERVICE PROJECTS. (a) A political subdivision that 1-11 receives state financial assistance for the construction of a 1-12 water supply or sewer service project under Subchapter K, Chapter 1-13 17, that is required to be repaid shall apply to the repayment of 1-14 the financial assistance or maintenance and operation of the 1-15 project an amount not less than the revenue from the operation of 1-16 the project multiplied by a fraction, the numerator of which is the 1-17 amount of state financial assistance received for the construction 1-18 of the project and the denominator of which is the total cost of 1-19 the construction of the project. 1-20 (b) At the request of the board or on the attorney general's 1-21 own initiative, the attorney general may file suit to enjoin an 1-22 actual or threatened violation of this section. 1-23 SECTION 2. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 2-1 emergency and an imperative public necessity that the 2-2 constitutional rule requiring bills to be read on three several 2-3 days in each house be suspended, and this rule is hereby suspended, 2-4 and that this Act take effect and be in force from and after its 2-5 passage, and it is so enacted.
