 1-6                            A BILL TO BE ENTITLED
 1-7                                   AN ACT
 1-8     relating to the use by political subdivisions that receive state
 1-9     financial assistance for water supply and sewer service projects in
1-10     economically distressed areas of the revenue from the operation of
1-11     those projects.
1-12           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-13           SECTION 1.  Subchapter J, Chapter 16, Water Code, is amended
1-14     by adding Section 16.352 to read as follows:
1-15           Sec. 16.352.  USE OF REVENUE FROM OPERATION OF WATER SUPPLY
1-16     OR SEWER SERVICE PROJECTS.  (a)  A political subdivision that
1-17     receives state financial assistance for the construction of a water
1-18     supply or sewer service project under Subchapter K, Chapter 17,
1-19     that is required to be repaid shall apply to the repayment of the
1-20     financial assistance or maintenance and operation of the project an
1-21     amount not less than the revenue from the operation of the project
1-22     multiplied by a fraction, the numerator of which is the amount of
1-23     state financial assistance received for the construction of the
1-24     project and the denominator of which is the total cost of the
1-25     construction of the project.
1-26           (b)  At the request of the board or on the attorney general's
1-27     own initiative, the attorney general may file suit to enjoin an
1-28     actual or threatened violation of this section.
1-29           SECTION 2.  The importance of this legislation and the
1-30     crowded condition of the calendars in both houses create an
1-31     emergency and an imperative public necessity that the
1-32     constitutional rule requiring bills to be read on three several
1-33     days in each house be suspended, and this rule is hereby suspended,
1-34     and that this Act take effect and be in force from and after its
1-35     passage, and it is so enacted.
