By: Moncrief S.B. No. 672 A BILL TO BE ENTITLED AN ACT 1-1 relating to restoring lost sick leave to a former state employee 1-2 returning to state employment. 1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-4 SECTION 1. (a) A state agency shall restore a sick leave 1-5 balance accumulated before September 1, 1991, for any person 1-6 currently employed by the agency who forfeited a sick leave balance 1-7 as a result of leaving employment with a state agency before 1-8 September 1, 1991, if the person was not employed by any state 1-9 agency for at least one month and entered employment with another 1-10 state agency not later than one year after the date the person's 1-11 prior employment with a state agency ended. To have a sick leave 1-12 balance restored under this section, the person must provide the 1-13 agency employing the person with evidence establishing that the 1-14 person is entitled to have the sick leave balance restored. A lost 1-15 sick leave balance must be restored in its entirety, less any 1-16 amount of the lost sick leave previously restored in any state 1-17 employment. 1-18 (b) A person may have a lost sick leave balance restored 1-19 under this section only if the person would have been entitled to 1-20 have the sick leave balance restored under the current General 1-21 Appropriations Act if that Act had been in effect when the person 1-22 entered employment with the agency currently employing the person. 1-23 (c) This Act expires September 1, 2000. 1-24 SECTION 2. The importance of this legislation and the 2-1 crowded condition of the calendars in both houses create an 2-2 emergency and an imperative public necessity that the 2-3 constitutional rule requiring bills to be read on three several 2-4 days in each house be suspended, and this rule is hereby suspended, 2-5 and that this Act take effect and be in force from and after its 2-6 passage, and it is so enacted.
