                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the establishment and funding of a program to educate
 1-2     residents about anatomical gifts.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subtitle B, Title 2, Health and Safety Code, is
 1-5     amended by adding Chapter 46 to read as follows:
 1-6              CHAPTER 46.  ANATOMICAL GIFT EDUCATIONAL PROGRAM
 1-7           Sec. 46.001.  DEVELOPMENT AND IMPLEMENTATION OF PROGRAM.
 1-8     (a)  The department shall develop a program to educate residents
 1-9     about anatomical gifts.  The program shall include information
1-10     about:
1-11                 (1)  the laws governing anatomical gifts, including
1-12     Subchapter Q, Chapter 521, Transportation Code, and Chapter 692;
1-13                 (2)  the procedures for becoming an organ donor or
1-14     donee; and
1-15                 (3)  the benefits of organ donation.
1-16           (b)  In developing the program, the department shall solicit
1-17     broad-based input reflecting recommendations of all interested
1-18     groups, including representatives of patients, providers, ethnic
1-19     groups, and geographic regions.
1-20           (c)  The department shall implement the program only to the
1-21     extent that funds are available from Section 521.421(g) or
1-22     521.422(c), Transportation Code.
1-23           SECTION 2.  Section 521.421, Transportation Code, is amended
1-24     by adding Subsection (g) to read as follows:
 2-1           (g)  The department shall collect an additional fee of $1 for
 2-2     the issuance or renewal of a license to fund the anatomical gift
 2-3     educational program established under Chapter 46, Health and Safety
 2-4     Code, if the person applying for or renewing a license opts to pay
 2-5     the additional fee.  The department shall remit fees collected
 2-6     under this subsection to the comptroller, who shall maintain the
 2-7     identity of the source of the fees.
 2-8           SECTION 3.  Section 521.422, Transportation Code, is amended
 2-9     by adding Subsection (c) to read as follows:
2-10           (c)  The department shall collect an additional fee of $1 for
2-11     the issuance or renewal of a personal identification card to fund
2-12     the anatomical gift educational program established under Chapter
2-13     46, Health and Safety Code, if the person applying for or renewing
2-14     a personal identification card opts to pay the additional fee.  The
2-15     department shall remit fees collected under this subsection to the
2-16     comptroller, who shall maintain the identity of the source of the
2-17     fees.
2-18           SECTION 4.  This Act takes effect September 1, 1999.
2-19           SECTION 5.  The importance of this legislation and the
2-20     crowded condition of the calendars in both houses create an
2-21     emergency and an imperative public necessity that the
2-22     constitutional rule requiring bills to be read on three several
2-23     days in each house be suspended, and this rule is hereby suspended.
