                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the establishment and funding of a program to educate
 1-3     residents about anatomical gifts.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subtitle B, Title 2, Health and Safety Code, is
 1-6     amended by adding Chapter 46 to read as follows:
 1-7              CHAPTER 46.  ANATOMICAL GIFT EDUCATIONAL PROGRAM
 1-8           Sec. 46.001.  DEVELOPMENT AND IMPLEMENTATION OF PROGRAM.
 1-9     (a)  The department shall develop a program to educate residents
1-10     about anatomical gifts.  The program shall include information
1-11     about:
1-12                 (1)  the laws governing anatomical gifts, including
1-13     Subchapter Q, Chapter 521, Transportation Code, and Chapter 692;
1-14                 (2)  the procedures for becoming an organ donor or
1-15     donee; and
1-16                 (3)  the benefits of organ donation.
1-17           (b)  In developing the program, the department shall solicit
1-18     broad-based input reflecting recommendations of all interested
1-19     groups, including representatives of patients, providers, ethnic
1-20     groups, and geographic regions.
1-21           (c)  The department shall implement the program only to the
1-22     extent that funds are available from Section 521.421(g) or
1-23     521.422(c), Transportation Code.
1-24           SECTION 2.  Section 521.421, Transportation Code, is amended
 2-1     by adding Subsection (g) to read as follows:
 2-2           (g)  The department shall collect an additional fee of $1 for
 2-3     the issuance or renewal of a license to fund the anatomical gift
 2-4     educational  program established under Chapter 46, Health and
 2-5     Safety Code, if the person applying for or renewing a license opts
 2-6     to pay the additional fee.  The department shall remit fees
 2-7     collected under this subsection to the comptroller, who shall
 2-8     maintain the identity of the source of the fees.
 2-9           SECTION 3.  Section 521.422, Transportation Code, is amended
2-10     by adding Subsection (c) to read as follows:
2-11           (c)  The department shall collect an additional fee of $1 for
2-12     the issuance or renewal of a personal identification card to fund
2-13     the anatomical  gift educational program established under Chapter
2-14     46, Health and Safety Code, if the person applying for or renewing
2-15     a personal identification card opts to pay the additional fee.  The
2-16     department shall remit fees collected under this subsection to the
2-17     comptroller, who shall maintain the identity of the source of the
2-18     fees.
2-19           SECTION 4.  This Act takes effect September 1, 1999.
2-20           SECTION 5.  The importance of this legislation and the
2-21     crowded condition of the calendars in both houses create an
2-22     emergency and an imperative public necessity that the
2-23     constitutional rule requiring bills to be read on three several
2-24     days in each house be suspended, and this rule is hereby suspended.
