No. 673 1-2 (In the Senate - Filed February 24, 1999; February 25, 1999, 1-3 read first time and referred to Committee on Health Services; 1-4 March 24, 1999, reported favorably by the following vote: Yeas 4, 1-5 Nays 0; March 24, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the establishment and funding of a program to educate 1-9 residents about anatomical gifts. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subtitle B, Title 2, Health and Safety Code, is 1-12 amended by adding Chapter 46 to read as follows: 1-13 CHAPTER 46. ANATOMICAL GIFT EDUCATIONAL PROGRAM 1-14 Sec. 46.001. DEVELOPMENT AND IMPLEMENTATION OF PROGRAM. 1-15 (a) The department shall develop a program to educate residents 1-16 about anatomical gifts. The program shall include information 1-17 about: 1-18 (1) the laws governing anatomical gifts, including 1-19 Subchapter Q, Chapter 521, Transportation Code, and Chapter 692; 1-20 (2) the procedures for becoming an organ donor or 1-21 donee; and 1-22 (3) the benefits of organ donation. 1-23 (b) In developing the program, the department shall solicit 1-24 broad-based input reflecting recommendations of all interested 1-25 groups, including representatives of patients, providers, ethnic 1-26 groups, and geographic regions. 1-27 (c) The department shall implement the program only to the 1-28 extent that funds are available from Section 521.421(g) or 1-29 521.422(c), Transportation Code. 1-30 SECTION 2. Section 521.421, Transportation Code, is amended 1-31 by adding Subsection (g) to read as follows: 1-32 (g) The department shall collect an additional fee of $1 for 1-33 the issuance or renewal of a license to fund the anatomical gift 1-34 educational program established under Chapter 46, Health and Safety 1-35 Code, if the person applying for or renewing a license opts to pay 1-36 the additional fee. The department shall remit fees collected 1-37 under this subsection to the comptroller, who shall maintain the 1-38 identity of the source of the fees. 1-39 SECTION 3. Section 521.422, Transportation Code, is amended 1-40 by adding Subsection (c) to read as follows: 1-41 (c) The department shall collect an additional fee of $1 for 1-42 the issuance or renewal of a personal identification card to fund 1-43 the anatomical gift educational program established under Chapter 1-44 46, Health and Safety Code, if the person applying for or renewing 1-45 a personal identification card opts to pay the additional fee. The 1-46 department shall remit fees collected under this subsection to the 1-47 comptroller, who shall maintain the identity of the source of the 1-48 fees. 1-49 SECTION 4. This Act takes effect September 1, 1999. 1-50 SECTION 5. The importance of this legislation and the 1-51 crowded condition of the calendars in both houses create an 1-52 emergency and an imperative public necessity that the 1-53 constitutional rule requiring bills to be read on three several 1-54 days in each house be suspended, and this rule is hereby suspended. 1-55 * * * * *
