                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the consideration of desalinization programs in local
 1-3     water planning.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Sections 16.054(a), (c), and (d), Water Code, are
 1-6     amended to read as follows:
 1-7           (a)  The board, commission, and Parks and Wildlife Department
 1-8     shall make available where appropriate technical and financial
 1-9     assistance for local water [such] planning.
1-10           (c)  When preparing a plan to be submitted under this
1-11     section, a person shall consider the implementation of a
1-12     desalinization program if practicable.
1-13           (d) [(c)]  The regional water planning group shall consider
1-14     any plan submitted under this section when preparing the regional
1-15     water plan under Section 16.053 of this code.
1-16           (e) [(d)]  When preparing individual water plans that address
1-17     drought or the development, management, or conservation of water
1-18     resources from the holders of existing permits, certified filings,
1-19     or certificates of adjudication, the water suppliers, groundwater
1-20     districts, special districts, irrigation districts, and other water
1-21     users should ensure that the plan is not in conflict with the
1-22     applicable approved regional water plan for their region.
1-23           SECTION 2.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
 2-1     emergency and an imperative public necessity that the
 2-2     constitutional rule requiring bills to be read on three several
 2-3     days in each house be suspended, and this rule is hereby suspended,
 2-4     and that this Act take effect and be in force from and after its
 2-5     passage, and it is so enacted.
