No. 822 1-2 (In the Senate - Filed March 2, 1999; March 4, 1999, read 1-3 first time and referred to Committee on Intergovernmental 1-4 Relations; April 8, 1999, reported favorably by the following vote: 1-5 Yeas 5, Nays 0; April 8, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the use of injunctions to prevent violations by 1-9 operators of automobile wrecking and salvage yards. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Chapter 397, Transportation Code, is amended by 1-12 adding Section 397.014 to read as follows: 1-13 Sec. 397.014. INJUNCTION. (a) A county may bring an action 1-14 for an injunction to prohibit a violation or threatened violation 1-15 of this chapter. 1-16 (b) The venue for the injunction proceeding is in the county 1-17 in which any part of the automobile wrecking and salvage yard is 1-18 located. 1-19 SECTION 2. This Act takes effect September 1, 1999. 1-20 SECTION 3. The importance of this legislation and the 1-21 crowded condition of the calendars in both houses create an 1-22 emergency and an imperative public necessity that the 1-23 constitutional rule requiring bills to be read on three several 1-24 days in each house be suspended, and this rule is hereby suspended. 1-25 * * * * *
