                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the authority of certain counties to regulate public
 1-2     nuisances.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Section 343.011(a), Health and Safety Code, is
 1-5     amended to read as follows:
 1-6           (a)  This section applies to the unincorporated area of a
 1-7     county with a population of 50,000 [125,000] or more.
 1-8           SECTION 2.  (a)  This Act takes effect September 1, 1999.
 1-9           (b)  the change in law made by this Act applies only to an
1-10     act that constitutes a public nuisance under Section 343.011,
1-11     Health and Safety Code, as amended by this Act, that is committed
1-12     on or after the effective date of this Act.  For purposes of this
1-13     section, an act is committed on or after the effective date of this
1-14     Act only if an element of the act occurs on or after that date.
1-15           (c)  An act that constitutes a public nuisance under Section
1-16     343.011, Health and Safety Code, as amended by this Act, that is
1-17     committed before the effective date of this Act is covered by the
1-18     law in effect when the act was committed, and the former law is
1-19     continued in effect for that purpose.
1-20           SECTION 3.  The importance of this legislation and the
1-21     crowded condition of the calendars in both houses create an
1-22     emergency and an imperative public necessity that the
 2-1     constitutional rule requiring bills to be read on three several
 2-2     days in each house be suspended, and this rule is hereby suspended.
