                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to service credit in the Judicial Retirement System of
 1-2     Texas Plan Two.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subchapter B, Chapter 838, Government Code, is
 1-5     amended by adding Section 838.106 to read as follows:
 1-6           Sec. 838.106.  CREDIT FOR YEAR IN WHICH ELIGIBLE FOR OFFICE.
 1-7     (a)  A contributing member may establish service credit in the
 1-8     retirement system for any calendar year during any part of which
 1-9     the member held an office included in the membership of the system.
1-10           (b)  A member may establish credit under this section by
1-11     depositing with the retirement system a contribution computed for
1-12     each month of credit claimed at the rate of six percent of the
1-13     member's current monthly compensation, plus, if the member does not
1-14     establish the credit before the first anniversary of the date of
1-15     first eligibility, interest computed on the basis of the state
1-16     fiscal year at an annual rate of 10 percent from the date of first
1-17     eligibility to the date of deposit.
1-18           SECTION 2.  This Act takes effect September 1, 1999.
1-19           SECTION 3.  The importance of this legislation and the
1-20     crowded condition of the calendars in both houses create an
1-21     emergency and an imperative public necessity that the
1-22     constitutional rule requiring bills to be read on three several
1-23     days in each house be suspended, and this rule is hereby suspended.
