 1-7           Amend S.B. No. 841 as follows:
 1-8           (1)  On page 1, line 47 between "airport" and the period,
 1-9     insert the following:
1-10           "except as permitted by a valid interlocal agreement".
1-11                            A BILL TO BE ENTITLED
1-12                                   AN ACT
1-13     relating to the jurisdiction of municipal courts in certain
1-14     criminal cases, punishable only by a fine, that arise under the
1-15     rules, orders, and resolutions of a joint airport board.
1-16           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-17           SECTION 1.  Section 29.003, Government Code, is amended by
1-18     amending Subsection (a) and adding Subsection (f) to read as
1-19     follows:
1-20           (a)  A municipal court, including a municipal court of
1-21     record, shall have exclusive original jurisdiction within the
1-22     territorial limits of the municipality in all criminal cases that:
1-23                 (1)  arise under:
1-24                       (A)  the ordinances of the municipality; or
1-25                       (B)  a resolution, rule, or order of a joint
1-26     board operating an airport under Section 22.074, Transportation
1-27     Code; and
1-28                 (2)  are punishable by a fine not to exceed:
1-29                       (A)  $2,000 in all cases arising under municipal
1-30     ordinances or resolutions, rules, or orders of a joint board that
1-31     govern  fire safety, zoning, or public health and sanitation,
1-32     including dumping of refuse; or
1-33                       (B)  $500 in all other cases arising under a
1-34     municipal ordinance or a resolution, rule, or order of a joint
1-35     board.
1-36           (f)  This section does not affect the powers given
1-37     exclusively to a joint board operating an airport under Section
1-38     22.074(d), Transportation Code.
1-39           SECTION 2.  Section 22.074, Transportation Code, is amended
1-40     by adding Subsection (e) to read as follows:
1-41           (e)  The powers exclusively given to a joint board under
1-42     Subsection (d) do not affect the jurisdiction of a municipal court
1-43     under Section 29.003, Government Code.  The jurisdiction of a
1-44     municipal court under that section does not authorize the officers
1-45     or employees of a municipality that is not a constituent agency of
1-46     the joint board to enter airport property to regulate, protect, or
1-47     police the airport.
1-48           SECTION 3.  This Act takes effect September 1, 1999.
1-49           SECTION 4.  The importance of this legislation and the
1-50     crowded condition of the calendars in both houses create an
1-51     emergency and an imperative public necessity that the
1-52     constitutional rule requiring bills to be read on three several
1-53     days in each house be suspended, and this rule is hereby suspended.
