No. 865 76R7560 WP-F A BILL TO BE ENTITLED 1-1 AN ACT 1-2 relating to the authority to establish transportation advisory 1-3 committees. 1-4 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-5 SECTION 1. Subchapter C, Chapter 201, Transportation Code, 1-6 is amended by adding Section 201.113 to read as follows: 1-7 Sec. 201.113. ADVISORY COMMITTEES. (a) The commission may 1-8 establish advisory committees to advise the department on any 1-9 matter under the jurisdiction of the department. 1-10 (b) Section 2110.005, Government Code, does not apply to an 1-11 advisory committee established under this section if the advisory 1-12 committee is: 1-13 (1) established for a specific and immediate need; and 1-14 (2) dissolved before the first anniversary of the date 1-15 the committee is created. 1-16 (c) A member of an advisory committee established under this 1-17 section may not receive compensation for serving on the committee, 1-18 but is entitled to reimbursement for reasonable expenses incurred 1-19 in performing the member's duties. 1-20 SECTION 2. Subchapter B, Chapter 361, Transportation Code, 1-21 is amended by adding Section 361.056 to read as follows: 1-22 Sec. 361.056. ADVISORY COMMITTEES. (a) The board may 1-23 establish advisory committees to advise the authority on any matter 1-24 under the jurisdiction of the authority. 2-1 (b) Section 2110.005, Government Code, does not apply to an 2-2 advisory committee established under this section if the advisory 2-3 committee is: 2-4 (1) established for a specific and immediate need; and 2-5 (2) dissolved before the first anniversary of the date 2-6 the committee is created. 2-7 (c) A member of an advisory committee established under this 2-8 section may not receive compensation for serving on the committee, 2-9 but is entitled to reimbursement for reasonable expenses incurred 2-10 in performing the member's duties. 2-11 SECTION 3. Subchapter B, Texas Motor Vehicle Commission Code 2-12 (Article 4413(36), Vernon's Texas Civil Statutes), is amended by 2-13 adding Section 2.14 to read as follows: 2-14 Sec. 2.14. ADVISORY COMMITTEES. (a) The board may 2-15 establish advisory committees to advise the board on any matter 2-16 under the jurisdiction of the board. 2-17 (b) Section 2110.005, Government Code, does not apply to an 2-18 advisory committee established under this section if the advisory 2-19 committee is: 2-20 (1) established for a specific and immediate need; and 2-21 (2) dissolved before the first anniversary of the date 2-22 the committee is created. 2-23 (c) A member of an advisory committee established under this 2-24 section may not receive compensation for serving on the committee, 2-25 but is entitled to reimbursement for reasonable expenses incurred 2-26 in performing the member's duties. 2-27 SECTION 4. Article 4413(37), Revised Statutes, is amended by 3-1 adding Section 12 to read as follows: 3-2 Sec. 12. ADVISORY COMMITTEES. (a) The authority may 3-3 establish advisory committees the authority considers necessary and 3-4 may determine the appropriate membership for each committee. 3-5 (b) The authority shall specify: 3-6 (1) the purpose and duties of any advisory committee 3-7 established under this section; and 3-8 (2) any project that a committee is required to 3-9 develop. 3-10 (c) Members of an advisory committee established under this 3-11 section serve at the will of the authority. The authority may 3-12 dissolve an advisory committee when necessary. 3-13 (d) Section 2110.005, Government Code, does not apply to an 3-14 advisory committee established under this section if the advisory 3-15 committee is: 3-16 (1) established for a specific and immediate need; and 3-17 (2) dissolved before the first anniversary of the date 3-18 the committee is created. 3-19 SECTION 5. The importance of this legislation and the 3-20 crowded condition of the calendars in both houses create an 3-21 emergency and an imperative public necessity that the 3-22 constitutional rule requiring bills to be read on three several 3-23 days in each house be suspended, and this rule is hereby suspended, 3-24 and that this Act take effect and be in force from and after its 3-25 passage, and it is so enacted.
