                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to student fees at the University of North Texas.
 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-3           SECTION 1.  Subsection (a), Section 54.5081, Education Code,
 1-4     is amended to read as follows:
 1-5           (a)  The [governing] board of regents of the University of
 1-6     North Texas may charge each student registered at the university a
 1-7     medical services fee not to exceed $50 [$25] for each semester of
 1-8     the regular term or 12-week summer session and not to exceed $25
 1-9     [$12.50] for each six-week or shorter term of the summer session.
1-10           SECTION 2.  Subchapter E, Chapter 54, Education Code, is
1-11     amended by adding Section 54.5082 to read as follows:
1-12           Sec. 54.5082.  RECREATIONAL FACILITY FEE; UNIVERSITY OF NORTH
1-13     TEXAS.  (a)  The board of regents of the University of North Texas
1-14     may impose a recreational facility fee in an amount not to exceed
1-15     $50 per student for each semester of the regular term or the summer
1-16     session on each student enrolled in the University of North Texas
1-17     for the sole purpose of constructing, operating, maintaining,
1-18     improving, and equipping a recreational facility or program at the
1-19     institution.  A fee imposed under this section is in addition to
1-20     any other use or service fee authorized to be imposed.
1-21           (b)  Revenue from a fee imposed under this section shall be
1-22     deposited to the credit of an account known as the "University of
1-23     North Texas recreational facility fee account" under the control of
1-24     the student fee advisory committee established under Section
 2-1     54.5031.
 2-2           (c)  The student fee advisory committee annually shall submit
 2-3     to the board of regents a complete and itemized budget for the
 2-4     recreational facility with a complete report of all recreational
 2-5     facility activities conducted during the past year and all
 2-6     expenditures made in connection with those activities.  The board
 2-7     may make changes in the budget that the board determines are
 2-8     necessary.  After approving the budget the board, in accordance
 2-9     with this section, may impose the recreational facility fees for
2-10     that year in amounts sufficient to meet the budgetary needs of the
2-11     recreational facility.  If the budget approved by the board
2-12     contains an expenditure for the construction of a facility, the
2-13     board may contract for the construction of the facility.
2-14           (d)  The board may not increase the amount of the
2-15     recreational facility fee by more than 10 percent in any academic
2-16     year unless the amount of the increase is approved by a majority of
2-17     the students voting in an election held for that purpose or by a
2-18     majority vote of the legislative body of the student government of
2-19     the institution.
2-20           (e)  A fee imposed under this section may not be considered
2-21     in determining the maximum student services fees that may be
2-22     imposed  under Section 54.503(b).
2-23           SECTION 3.  The change in law made by this Act applies
2-24     beginning with fees imposed for the 1999 fall semester.
2-25           SECTION 4.  The importance of this legislation and the
2-26     crowded condition of the calendars in both houses create an
 3-1     emergency and an imperative public necessity that the
 3-2     constitutional rule requiring bills to be read on three several
 3-3     days in each house be suspended, and this rule is hereby suspended,
 3-4     and that this Act take effect and be in force from and after its
 3-5     passage, and it is so enacted.
