No. 935 1-2 (In the Senate - Filed March 5, 1999; March 8, 1999, read 1-3 first time and referred to Committee on Intergovernmental 1-4 Relations; April 22, 1999, reported favorably by the following 1-5 vote: Yeas 4, Nays 0; April 22, 1999, sent to printer.) 1-6 A BILL TO BE ENTITLED 1-7 AN ACT 1-8 relating to the purposes for which certain municipalities may use 1-9 revenue from the municipal hotel occupancy tax. 1-10 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-11 SECTION 1. Subchapter B, Chapter 351, Tax Code, is amended 1-12 by adding Sections 351.1012 and 351.1066 to read as follows: 1-13 Sec. 351.1012. USE OF REVENUE: SMALL MUNICIPALITIES. In 1-14 addition to the uses permitted by Section 351.101(a), a 1-15 municipality with a population of less than 2,000 may use hotel 1-16 occupancy tax revenue to provide police protection in the 1-17 municipality. 1-18 Sec. 351.1066. ALLOCATION OF REVENUE: SMALL MUNICIPALITIES. 1-19 The governing body of a municipality with a population of less than 1-20 2,000 may allocate hotel occupancy tax revenue among the permitted 1-21 uses as determined by ordinance. 1-22 SECTION 2. The importance of this legislation and the 1-23 crowded condition of the calendars in both houses create an 1-24 emergency and an imperative public necessity that the 1-25 constitutional rule requiring bills to be read on three several 1-26 days in each house be suspended, and this rule is hereby suspended, 1-27 and that this Act take effect and be in force from and after its 1-28 passage, and it is so enacted. 1-29 * * * * *
