No. 965 By: Nelson 1-8 A BILL TO BE ENTITLED 1-9 AN ACT 1-10 relating to granting limited state law enforcement authority to 1-11 commissioned law enforcement officers of the National Park Service. 1-12 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: 1-13 SECTION 1. Article 2.122, Code of Criminal Procedure, is 1-14 amended by adding Subsection (d) to read as follows: 1-15 (d) A commissioned law enforcement officer of the National 1-16 Park Service is not a peace officer under the laws of this state, 1-17 except that the officer has the powers of arrest, search, and 1-18 seizure as to any offense under the laws of this state committed 1-19 within the boundaries of a national park or national recreation 1-20 area. In this subsection, "national park or national recreation 1-21 area" means a national park or national recreation area included in 1-22 the National Park System as defined by 16 U.S.C. Section 1c(a). 1-23 SECTION 2. The importance of this legislation and the 1-24 crowded condition of the calendars in both houses create an 1-25 emergency and an imperative public necessity that the 1-26 constitutional rule requiring bills to be read on three several 1-27 days in each house be suspended, and this rule is hereby suspended, 1-28 and that this Act take effect and be in force from and after its 1-29 passage, and it is so enacted. 1-30 * * * * *
