 1-7     Amend S.B. No. 1034 by striking Line 27 on Page 1 and substituting
 1-8     the following:
 1-9                       "(C)  a court of appeals as described by Section
1-10     22.201"
1-11                            A BILL TO BE ENTITLED
1-12                                   AN ACT
1-13     relating to the authority of a court of appeals to purchase or
1-14     acquire liability insurance.
1-15           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-16           SECTION 1.  Subdivision (2), Subsection (f), Section 612.004,
1-17     Government Code, as added by Chapter 1035, Acts of the 75th
1-18     Legislature, Regular Session, 1997, is amended to read as follows:
1-19                 (2)  "State agency" means:
1-20                       (A)  a department, board, commission, committee,
1-21     council, agency, office, or other entity in the executive,
1-22     legislative, or judicial branch of state government, the
1-23     jurisdiction of which is not limited to a geographical portion of
1-24     the state;
1-25                       (B)  [.  The term includes] an institution of
1-26     higher education as defined by Section 61.003, Education Code; and
1-27                       (C)  a court of appeals.
1-28           SECTION 2.  Section 612.004, Government Code, as added by
1-29     Chapter 1035, Acts of the 75th Legislature, Regular Session, 1997,
1-30     is amended by adding Subsection (g) to read as follows:
1-31           (g)  For purposes of Section 659.012, the cost of insurance
1-32     purchased or acquired by a court of appeals under this section is
1-33     not included in determining the salary of a justice serving on the
1-34     court.
1-35           SECTION 3.  This Act takes effect September 1, 1999.
1-36           SECTION 4.  The importance of this legislation and the
1-37     crowded condition of the calendars in both houses create an
1-38     emergency and an imperative public necessity that the
1-39     constitutional rule requiring bills to be read on three several
1-40     days in each house be suspended, and this rule is hereby suspended.
