                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the application of the open records law to information
 1-2     about a business prospect who has engaged in economic development
 1-3     negotiations with a governmental body.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Subchapter C, Chapter 552, Government Code, is
 1-6     amended by adding Section 552.131 to read as follows:
 1-7           Sec. 552.131.  EXCEPTION:  ECONOMIC DEVELOPMENT INFORMATION.
 1-8     (a)  Information is excepted from the requirements of Section
 1-9     552.021 if the information relates to economic development
1-10     negotiations involving a governmental body and a business prospect
1-11     that the governmental body seeks to have locate, stay, or expand in
1-12     or near the jurisdiction of the governmental body and the
1-13     information relates to:
1-14                 (1)  the finances of the business prospect;
1-15                 (2)  a trade secret or proprietary information of the
1-16     business prospect; or
1-17                 (3)  commercially sensitive information about the
1-18     business prospect that the business prospect requests be withheld
1-19     from disclosure.
1-20           (b)  This section does not except from the requirements of
1-21     Section 552.021 information about a financial or other incentive
1-22     being offered to the business prospect:
 2-1                 (1)  by the governmental body; or
 2-2                 (2)  by another person, if the financial or other
 2-3     incentive may directly or indirectly result in the expenditure of
 2-4     public funds by a governmental body or in a reduction in revenues
 2-5     received by a governmental body from any source of revenue.
