                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the creation of the Texas Tech University System.
 1-2           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-3           SECTION 1.  The chapter heading to Chapter 109, Education
 1-4     Code, is amended to read as follows:
 1-5                 CHAPTER 109.  TEXAS TECH UNIVERSITY SYSTEM
 1-6           SECTION 2.  Subchapter A, Chapter 109, Education Code, is
 1-7     amended by adding Section 109.001 to read as follows:
 1-8           Sec. 109.001.  TEXAS TECH UNIVERSITY SYSTEM.  (a)  The Texas
 1-9     Tech University System hereby created is composed of all those
1-10     institutions and entities presently under the governance, control,
1-11     jurisdiction, and management of the board of regents of Texas Tech
1-12     University.
1-13           (b)  The Texas Tech University System shall also be composed
1-14     of such other institutions and entities as from time to time may be
1-15     assigned by specific legislative act to the governance, control,
1-16     jurisdiction, and management of the Texas Tech University System.
1-17           (c)  The governance, control, jurisdiction, organization, and
1-18     management of the Texas Tech University System is hereby vested in
1-19     the present board of regents of Texas Tech University, which will
1-20     hereinafter be known and designated as the board of regents of the
1-21     Texas Tech University System.  The board by rule may delegate a
1-22     power or duty of the board to an officer, employee, or other agent
1-23     of the board.
1-24           SECTION 3.  The importance of this legislation and the
 2-1     crowded condition of the calendars in both houses create an
 2-2     emergency and an imperative public necessity that the
 2-3     constitutional rule requiring bills to be read on three several
 2-4     days in each house be suspended, and this rule is hereby suspended,
 2-5     and that this Act take effect and be in force from and after its
 2-6     passage, and it is so enacted.
 2-7                          COMMITTEE AMENDMENT NO. 1
 2-8           Amend S.B. 1088 by striking SECTION 3 of the bill and adding
 2-9     the following appropriately numbered SECTIONS:
2-10           SECTION ___.  (a)  Except as provided by Subsection (b), this
2-11     Act takes effect September 1, 1999.
2-12           (b)  Not later than August 31, 1999, the Texas Higher
2-13     Education Coordinating Board shall review and determine whether to
2-14     approve the creation of the Texas Tech University System as
2-15     provided by this Act.  If the coordinating board does not approve
2-16     the creation of that system on or before August 31, 1999, the Texas
2-17     Tech University System is not created and this Act has no effect.
2-18           SECTION ____.  The importance of this legislation and the
2-19     crowded condition of the calendars in both houses create an
2-20     emergency and an imperative public necessity that the
2-21     constitutional rule requiring bills to be read on three several
2-22     days in each house be suspended, and this rule is hereby suspended,
2-23     and that this Act take effect and be in force according to its
2-24     terms, and it is so enacted.
