                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to excavation operations of employees of the Texas
 1-2     Department of Transportation.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subsection (d), Section 3, Chapter 1407, Acts of
 1-5     the 75th Legislature, Regular Session, 1997 (Article 9033, Vernon's
 1-6     Texas Civil Statutes), is amended to read as follows:
 1-7           (d)  Excavation by an employee of the Texas Department of
 1-8     Transportation on a segment of the state highway system is not
 1-9     subject to this Act, provided that such excavation is [:]
1-10                 [(1)  less than 24 inches in depth; and]
1-11                 [(2)  no] more than 10 feet from the right-of-way line.
1-12           SECTION 2.  The importance of this legislation and the
1-13     crowded condition of the calendars in both houses create an
1-14     emergency and an imperative public necessity that the
1-15     constitutional rule requiring bills to be read on three several
1-16     days in each house be suspended, and this rule is hereby suspended,
1-17     and that this Act take effect and be in force from and after its
1-18     passage, and it is so enacted.
