A BILL TO BE ENTITLED
AN ACT
1-1 relating to the use of competitive bidding by an airport governed
1-2 by a joint board.
1-3 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1-4 SECTION 1. Subsection (a), Section 22.084, Transportation
1-5 Code, is amended to read as follows:
1-6 (a) A joint board may enter into an agreement to spend the
1-7 proceeds of revenue bonds issued by its [If] constituent agencies,
1-8 the proceeds of bonds issued by [or] a nonprofit corporation
1-9 created under Section 22.152, [issues revenue bonds to finance the
1-10 construction or acquisition of a facility or other improvement at
1-11 an airport, the proceeds of the bonds] and any other airport income
1-12 or revenue [may be spent on projects for which the proceeds,
1-13 income, or revenue may otherwise be spent. An agreement may be
1-14 made to spend all or a portion of the proceeds, income, or revenue]
1-15 for the planning, construction, or acquisition of facilities
1-16 authorized by Sections 22.011(a)-(c) and 22.012 without inviting,
1-17 advertising for, or otherwise requiring competitive bids. A
1-18 contract wholly or partly funded with proceeds, income, or revenue
1-19 under this subsection shall be let in accordance with the joint
1-20 board's rules and policies relating to creation of contracting
1-21 opportunities for minority- and women-owned businesses.
1-22 SECTION 2. The importance of this legislation and the
1-23 crowded condition of the calendars in both houses create an
1-24 emergency and an imperative public necessity that the
2-1 constitutional rule requiring bills to be read on three several
2-2 days in each house be suspended, and this rule is hereby suspended,
2-3 and that this Act take effect and be in force from and after its
2-4 passage, and it is so enacted.
