                                A BILL TO BE ENTITLED
                                       AN ACT
 1-1     relating to the disposition of the proceeds of fines collected for
 1-2     overweight vehicles.
 1-3           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-4           SECTION 1.  Subsection (g), Section 621.506, Transportation
 1-5     Code, is amended to read as follows:
 1-6           (g)  A governmental entity that collects a fine under this
 1-7     section for an offense involving a vehicle having a gross weight
 1-8     that is more than 5,000 pounds heavier than the vehicle's allowable
 1-9     gross weight shall send an amount equal to 50 percent of the fine
1-10     to the comptroller unless the offense occurred within 20 miles of
1-11     an international border in which event the entire amount of the
1-12     fine shall be deposited for the purposes of road maintenance in:
1-13                 (1)  the municipal treasury, if the fine was imposed by
1-14     a municipal court; or
1-15                 (2)  the county treasury, if the fine was imposed by a
1-16     justice court.
1-17           SECTION 2.  The change in law made by this Act to Subsection
1-18     (g), Section 621.506, Transportation Code, applies only to a fine
1-19     collected on or after the effective date of this Act, regardless of
1-20     whether the offense for which the fine is collected occurred
1-21     before, on, or after the effective date of this Act.
1-22           SECTION 3.  This Act takes effect September 1, 1999.
1-23           SECTION 4.  The importance of this legislation and the
1-24     crowded condition of the calendars in both houses create an
 2-1     emergency and an imperative public necessity that the
 2-2     constitutional rule requiring bills to be read on three several
 2-3     days in each house be suspended, and this rule is hereby suspended.
