                                A BILL TO BE ENTITLED
 1-1                                   AN ACT
 1-2     relating to the selection of the disposal site designated by the
 1-3     Texas Low-Level Radioactive Waste Disposal Authority.
 1-4           BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 1-5           SECTION 1.  Section 402.084, Health and Safety Code, is
 1-6     amended by adding Subsection (d) to read as follows:
 1-7           (d)  The board shall evaluate each site according to the
 1-8     latest methods of the engineering, radiological, geological, and
 1-9     hydrogeological sciences to determine whether the site will be
1-10     adequate to store safely the wastes intended for disposal at the
1-11     site.
1-12           SECTION 2.  Sections 402.0921 and 402.0922, Health and Safety
1-13     Code, are amended to read as follows:
1-14           Sec. 402.0921.  COMMUNITY SUPPORT OF SITE AREA.  The board
1-15     may not designate a disposal site unless the board has the written
1-16     endorsement of the site by:
1-17                 (1)  the county judge of each county in which the site
1-18     is located;
1-19                 (2)  the mayor of the municipality that is closest to
1-20     the site; and
1-21                 (3)  the superintendent of each independent school
1-22     district in which the site is located [Notwithstanding any other
1-23     law or other provision of this chapter, the board shall select as
1-24     the disposal site, a site:]
 2-1                 [(1)  within Hudspeth County, Texas, and]
 2-2                 [(2)  circumscribed on the north by 31 degrees north
 2-3     latitude, 15' and 00"; on the south by 31 degrees north latitude,
 2-4     00' and 00"; on the east by 105 degrees longitude, 00' and 00"; and
 2-5     on the west by 105 degrees longitude, 22' and 30"].
 2-6           Sec. 402.0922.  EMINENT DOMAIN.  The authority may acquire
 2-7     land for a disposal site [within the geographical area described in
 2-8     Section 402.0921] by condemnation and in accordance with Chapter 21
 2-9     of the Property Code.
2-10           SECTION 3.  The importance of this legislation and the
2-11     crowded condition of the calendars in both houses create an
2-12     emergency and an imperative public necessity that the
2-13     constitutional rule requiring bills to be read on three several
2-14     days in each house be suspended, and this rule is hereby suspended,
2-15     and that this Act take effect and be in force from and after its
2-16     passage, and it is so enacted.
